MEMORANDUM ORDER
COPENHAVER, District Judge.
This matter is before the court on plaintiffs’ complaint and the stipulations of the' parties. Plaintiffs’ complaint seeks a permanent injunction and declaratory relief prohibiting defendants from interfering, through the use of criminal warrants or otherwise, with their interstate transportation of medical waste from West Virginia to other states and for a declaration of the rights, duties and obligations of the parties.
