Appeal by the plaintiff, The People of the State of New York, from an order of the County Court of Kings county, entered in the office of the clerk of said court on the 6th day of May, 1912, in so far as said order remits any part of the forfeiture of the undertaking herein.

Rich, J.:
This appeal is by the People from an order of a county judge remitting the forfeiture of a bail undertaking from $1,500 to *180$1,000. The facts are undisputed. On January 2, 1910, Antonio Montelione, Erasino Euhino and Pietro Oompisiano were arrested, charged with the crime of extortion, and held to await the action of the grand jury. On January 28, 1910, they were jointly indicted, charged with that crime. On March fifteenth and • sixteenth following, Montelione was tried, found guilty as charged in the indictment and sentenced to a term of years in State prison.. The judgment of…
