This litigation arises from certain testimony given during the debtors’ confirmation hearing held on January 19, 2005. The plaintiffs, Steven Salsberg (“Steven”) and his mother, Gloria Salsberg (“Gloria,” and collectively, the “Salsbergs”), hold warrants distributed under the debtors’ confirmed plan (the “Plan”).
