The controversy before us involves two well-known insurance companies vying to provide the health care plan offered by the State of Rhode Island (State) to about 52,000 state employees, retirees and eligible dependants. Both the plaintiff, Blue Cross and Blue Shield of Rhode Island (Blue Cross), and the defendant-interve-nor, UnitedHealtheare (United), submitted bids for the three-year contract expected to commence on January 1, 2005.
