This case came before the Supreme Court on the appeal of the plaintiff, HK & S Construction Holding Corp. (HK & S or plaintiff), of a Superior Court grant of summary judgment in favor of the defendants, Town of Middletown (town), 1 Robert J. Rafferty (Rafferty), and Woodard & Curran, Inc. (Woodard & Curran).
