The West Virginia Department of Environmental Protection (hereafter “DEP”) brings this petition to appeal an October 26, 2010, order of the Circuit Court of Kanawha County. By way of the October 26 order, the circuit court affirmed the decision of the West Virginia Public Employee’s Grievance Board (hereafter “Grievance Board” or “Board”) with regard to the grievance filed by Michelle L.
