This suit was instituted by the surviving wife, minor daughter and parents of Fletcher S. Eubanks, deceased, for whose death they sought to recover damages against H. L. Schwalbe, operating under the trade name of Interstate Contracting Company, United States Fidelity & Guaranty Company and Panhandle and Santa Fe Railway Company.
