The amended complaint in this taxpayer’s action, brought pursuant to section 51 of the General Municipal Law, seeks a declaratory judgment to the effect that chapters 200-208, inclusive, of the Laws of 1953 are unconstitutional. The plaintiff has made a motion for a temporary injunction restraining the Mayor and the .board of estimate of the City of New York, defendants in the action, from exercising the right given to the Mayor by chapters 200 and 201 to appoint some of the members of the New York City Transit Authority, created by those chapters, and from entering into an agreement,…
