MEMORANDUM AND ORDER

NEALON, Chief Judge.

On March 15, 1982, the plaintiff filed this action, alleging that the defendants violated his rights when they discharged him from the United States Navy because he allegedly admitted to being a homosexual. The defendants have moved to dismiss, asserting, inter alia, that the action is barred by the statute of limitations. The court has decided to treat this motion as one for summary judgment 1 and, for the reasons set forth below, will grant the defendants’ motion.
