Appeal by defendant from a judgment of the Supreme Court, Westchester County, rendered February 21, 1979, convicting him of robbery in the third degree, upon a jury verdict, and imposing sentence. Judgment reversed, on the law, and new trial ordered. No issue has been presented with respect to the facts upon which the conviction is based. Following the close of the evidence and prior to the summations, one of the members of the jury approached the court and revealed that he was acquainted with two of the witnesses who had testified, one for the prosecution and one for the defense.
