In this case we examine a habeas petitioner’s claim that he received ineffective assistance of counsel in the state court appeal of his conviction. Leslie Jameson appeals from the July 13, 1993, judgment of the District Court for the Eastern District of New York (I. Leo Glasser, Judge) dismissing his petition for a writ of habeas corpus. On appeal, Jameson argues that he was denied effective assistance of counsel because his prior counsel decided not to raise in the Appellate Division an argument subsequently upheld by the Court of Appeals on an appeal by Jameson’s…
