The defendant, Hanover Insurance Company, appeals the decision of the Superior Court {McHugh, J.) finding that an exclusion in the policy issued by the defendant was void and ordering the defendant to pay the plaintiff, Scott A. Murley, $5,000 for medical payments. We affirm.

The trial court found the following facts. The plaintiff purchased an insurance policy providing $100,000 in personal liability, $100,000 in underinsured motorist coverage and $5,000 in medical payments coverage from the defendant.
