Appeal from a judgment of the County Court of Chemung County (Castellino, J.), rendered November 6, 1987, upon a verdict convicting defendant of the crime of assault in the second degree.

On May 7, 1987, defendant, an inmate at Elmira Correctional Facility in Chemung County, was involved in an altercation with an on-duty correction officer. The altercation occurred outside mess hall two, after defendant had finished lunch, and arose out of the correction officer’s directions to defendant, who was scheduled to work in mess hall one for *920the remainder of the lunch period.
