UNDERWOOD, District Judge.

This is an action brought by Helen S. Bayersdorfer, beneficiary, under an accident insurance policy issued by the Massachusetts Protective Association, defendant herein. Judgment in the sum of $5,000, the face value of the policy, is asked with interest. The policy in question was issued to Stanley W. Bayersdorfer by the defendant association August 15, 1933.
