The plaintiff sues for damages for injuries to his minor child struck by an electric ear of defendant, thrown to the ground, and the wheels of the ear passing over the legs of the child, rendering necessary the amputation of both, the petition charging that the accident was due solely to the gross carelessness of the defendant’s agent, the motorman. The defendant’s answer denies the imputed negligence, and alleges the accident was due solely to the fault and negligence of the child and its parents. Thereafter the defendant excepted that the…
