This Avas an action to enjoin the city of Humboldt from collecting certain paving assessments. The injunction Avas denied, and plaintiffs appeal.
The first contention made is that the ordinance, upon which the proceedings were based, is void, for the reason that the municipal records do not shoAv that it was read the third time before its final passage.
The city charter provides that ordinances shall be read on three different days unless, by a three-fourths vote of the council, that rule is dispensed with, and shall require for their adoption the vote of a majority of the members of the…
