&emdash;The testimony on behalf of the State tended to show that the prosecuting witness, John-Perry, a boy about 13 years of age, and two other boys had been playing, during the afternoon, in an inclosed chicken yard or pasture of the appellant s; that, about 6:30, as it was getting dark, they had grown tired of their play, and were resting; that Ferry was lying down, and was concealed by sunflower stalks; that the other two boys were standing or sitting near him; that they were on a bank above appellant’s chicken house, which was, in a general way, between them and appellant’s residence;…
