In this diversity action, filed pursuant to 28 U.S.C. § 1332(a)(1), defendant-appellant Rush Trucking Corp. (“Rush Trucking”) appeals from a judgment entered upon a jury verdict in the district court for the Western District of New York (Leslie G. Foschio, Magistrate Judge). The judgment awarded $931,218 to plaintiff-appel-lee Adrianne Rounds for damages suffered as the result of a car accident.
