STEPHAN, Judge.

Plaintiff, Chase Electric Company (“Chase!’) filed a three count action against defendant, The Acme Battery Manufacturing Company (“Acme”), seeking recovery for breach of contract, in quantum meruit and for misrepresentation. All three counts arose from electrical work Chase performed at Acme’s plant pursuant to a contract between Chase and Acme. Acme filed a motion to dismiss Chase’s petition for failure to state a claim upon which relief could be granted. The trial court initially sustained this motion.
