Vincent D. Spinosa was convicted by a Massachusetts federal jury of conspiracy to possess with intent to distribute cocaine in violation of 21 U.S.C. § 846 and possession with intent to distribute cocaine in violation of 21 U.S.C. § 841(a)(1) and 18 U.S.C. § 2. Spinosa urges this court to reverse his conviction on the grounds that the trial court erred in: (1) denying Spinosa’s motion for a hearing to suppress evidence under Franks v. Delaware, 438 U.S. 154, 98 S.Ct. 2674, 57 L.Ed.2d 667 (1978); (2) denying Spinosa’s motion to exclude pri- or “bad acts” evidence;…
