The complaint is for the foreclosure of a mortgage upon real estate located in the town of Stratford. The defendant filed a cross-complaint in three counts. A demurrer to the first and second counts was sustained (Jennings, J.) and the defendant amended his cross-complaint by adding a fourth count. A demurrer to this fourth count was sustained (Yeomans, J.), the third count was withdrawn, and, the defendant failing to plead further, judgment was rendered in favor of the plaintiff.
