ORDER

MeDADE, District Judge.

Before the Court is Petitioner’s Motion for Reconsideration. (Doc. # 17). For the reasons set forth below, Petitioner’s motion is GRANTED.

BACKGROUND

On July 7, 1997, Petitioner, Quinton Neal, filed a Petition for Writ of Habeas Corpus by a Person in State Custody pursuant to 28 U.S.C. § 2254. (Doc. #3). On January 8, 1998, Respondent, Rodney Ahitow, filed a Motion to Dismiss. (Doc. # 9).
