This action was tried to a jury. It was given to the panel for final consideration on a Friday afternoon with instructions to report a sealed verdict on the following Monday morning; soon afterwards the court adjourned until that time. The jury deliberated until about half past ten o’clock in the evening óf that Friday, when they were allowed to disperse by the sheriff acting by order of the court.
