Grice, Justice.

On a former appearance of this case the judgment was reversed because the judge sustained a demurrer and dismissed the action, the demurrer being limited to an attack on the jurisdiction of the court, and not including the general ground that the petition stated no cause of action ot showed no ground for equitable relief. In the opinion it was expressly stated that no adjudication was made with reference thereto. Blount v. Metropoli tan Life Insurance Co., supra.
