OPINION AND ORDER
DOMINGUEZ, District Judge.
Pending before the Court is defendant, Wyeth Pharmaceuticals Company’s (“de fendant”) Motion to Dismiss. (Docket No. 10). For the reasons stated below, defendant’s request to dismiss is DENIED.
I. PROCEDURAL BACKGROUND
On December 10, 2003, plaintiffs presented a claim for unpaid wages under the Fair Labor Standard Act (“FLSA”), as amended, 29 U.S.C.A § 201. (Docket No. 1).
