BUFFINGTON, Circuit Judge.
In the court below William Fehl, a citizen of the German empire, brought suit against the Ohio & Pittsburgh Milk Company, a corporation of Pennsylvania, for damages sustained by him through its negligence. He recovered a verdict, on which the court entered judgment in his favor. Whereupon the defendant sued out this writ, and assigned for error the refusal of its motion for judgment non obstante veredicto and the denial of its point for binding instructions.
