Appellant brought suit to recover a balance due it on an account stated and on a promissory note. Defendant pleaded the general issue, illegality, want of consideration and a set-off. Under the common counts defendant claimed by way of set-off damages for breach of an alleged contract to give defendant brokerage work under which he would earn at least $2,000 annually for two years and an account stated showing moneys due him.
