Affirming.

Minnie B. Robinson died testate a citizen and resident of Lincoln county, Ky., and her will was duly probated.

After disposing of a certain portion of her estate by her will, the concluding paragraph reads:

“The remainder of the nine tenth (9/10) of my estate go to the following parties. One-half (%) of this sum I bequeath to my sister, Mary Alice Lusk, and the other half (%) to the heirs of my deceased brother, H. Clay Kauffman, namely, H. Clay Kauffman, Mary F. Kauffman, and the children of my deceased niece, Louise Shackelford, in equal parts —…
