which will be referred to as the “Buerck Case,” comes here upon a special appeal granted by one of the judges of this court from an order of Division No. 14 of the Circuit Court of the City of St. Louis, overruling a motion of defendant Mid-Nation Iron Products Company to vacate the appointment of a receiver.
