McDONOUGH, Justice.

Aileen Webb, plaintiff and respondent, brought an action in the district court against the defendants and appellants for alleged assault and battery which took place on the loading platform of an amusement concession known as the “giant racer” at Saltair Beach on the night of June 22,1940. The jury returned a verdict in the sum of $5,022,50, the entire amount claimed by plaintiff as damages at the time the case was submitted to the jury.
