This is an appeal from the action of the district court of Murray county, Okla., in refusing to vacate an order of the county court of said county admitting the will of Robert J. Vandersliee, deceased, to probate.

The appeal is prosecuted by Eliza Flynn, nee Vandersliee, the daughter of testator, Robert J. Vandersliee, deceased, against the executors and the heirs at law. The parties appear here in the same relative positions as they appeared in the trial court, and they will be so referred to as plaintiff and defendants.
