This motion presents for determination an issue of law. The action is brought to cancel a deed of trust of personal property alleged to have been revoked under section 23 of the Personal Property Law;

The deed of trust provides in substance that the plaintiff, Henry de Groot Robinson, the creator thereof, shall receive the income therefrom during his life; that, if plaintiff leaves him surviving a wife or a wife and children, or issue of a deceased child or children, the fund shall be divided into equal shares, one for a possible wife if surviving, and one for each of the children or issue of…
