Appeal by the plaintiff, Base Ball Players Fraternity, Inc., from a judgment of the Supreme Court, in favor of the defendant, entered in the office of the clerk of the county of New York on the 1st day of July, 1914, upon a dismissal of the complaint by direction of the court at the close of plaintiff’s case, and also from an order entered in said clerk’s office on the 26th day of May, 1914, denying plaintiff’s motion for a new trial made upon the minutes.

This is an action on an assigned claim of one Kurt M. Hageman for compensation for services under a written contract of employment executed by the defendant with him on the 18th day of September, 1911, by which he was employed to perform “such duties pertaining to the exhibition of the game of base ball ” as defendant might require of him during the American League season for the year 1912, which embraced the period of six months from April 15, 1912, to October 15, 1912, and for which it agreed to pay him $400 per month.
