The owner of a parcel of land in Rice county contracted to sell and convey it td one John Chapman. Chapman failed to make the payments required by the contract and on March 18, 1924, the owner served upon him the statutory notice terminating the contract unless such payments were made within 30 days thereafter. No payments were made and, at the expiration of the 30 day period, the then owner conveyed the land to plaintiff by warranty deed.

The defendant lumber company obtained a judgment against Chapman on March 17, 1924, which was docketed in Bice county on the same date. In…
