Appeal from a judgment of the Seneca County Court (Dennis E Bender, J.), rendered July 13, 2009. The judgment convicted defendant, upon a nonjury verdict, of criminal mischief in the fourth degree, petit larceny and possession of burglar’s tools.
It is hereby ordered that the judgment so appealed from is unanimously modified on the law by reducing the amount of restitution ordered to $129.06 and as modified the judgment is affirmed.
