Tbis is an action on a policy of fire insurance. Verdict and judgment below were in favor of plaintiff for $1,908.15. Tbe company appealed and has assigned errors.

It appears from tbe record that tbis policy was issued and delivered to tbe plaintiff on November 28, 1899, and insured a country dwelling bouse in Butherford County, including tbe household furniture. On March 24, 1900, tbis property was destroyed by fire.

Tbe conditions of tbe policy material to tbe present investigation are, first, that tbe insured is tbe sole and unconditional owner in fee of said property; second, that tbe…
