I. Introduction
This matter came before the undersigned United States Magistrate Judge pursuant to the parties’ consent, see, Title 28 U.S.C. § 636(c), for the conduct of a Bench Trial. The Trial commenced on August 24, 2009, and concluded on August 27, 2009.
