RESTANI, Judge:

This appeal centers on the factual sufficiency of allegations of employment discrimination made by plaintiff-appellant Paul A. Carter, an African-American, against William L. Ball, III, the Secretary of the Navy (“the Navy”). At the end of Carter’s case-in-chief, the district court granted the Navy’s motion for dismissal.
