I.Background

On or about May 8, 1997, Eduardo La Torres (“Petitioner” or “La Torres”), a pro se litigant, filed a petition for a writ of habeas corpus (“Petition”) with this Court. La Torres had been convicted, in 1991, in New York State Supreme Court, New York County, of two counts of attempted murder in the first degree, one count of criminal possession of a weapon in the second degree, criminal possession of a weapon in the third degree, and reckless endangerment in the first degree.
