[¶ 1] The State of Maine appeals from a judgment entered in the Superior Court (Hancock County, Cuddy, J.) granting Vla-dek Filler’s motion for a new trial pursuant to M.R.Crim. P. 33 following a jury verdict finding him guilty of one count of gross sexual assault (Class A), 17-A M.R.S. § 253(1)(A) (2009), and two counts of assault (Class D), 17-A M.R.S. § 207(1)(A) (2009).
