In this action by appellee against the appellant for damages allegedly resulting from the negligent operation by the latter of one of its freight trains, the jury, to which the formal issues were submitted for trial, returned a verdict for appellee in the amount of $10,000.00. Consistent judgment on the verdict was entered and this appeal was taken therefrom.
