The plaintiff, Martin Cogley, and one Martin J. Fanning, (the former being at the time a minor) jointly purchased of Patch & Fisk, agents of one Brayley, a threshing machine and horse power for the *399sum of $700, of which sum they paid $100, and gave their joint notes for $600, to secure the payment of which, and as collateral security therefor, they executed to Brayley a chattel mortgage upon the threshing machine and horse power,'a span of horses owned by Cogley, and a span of mares owned by Panning.
