This is a suit to recover damages for negligence in transporting an interstate shipment of sheep for failure to observe duties imposed by the United States Statutes, commonly called the “28-hour law.”

The facts are substantially as follows: On November 3, 1906, the defendant in error, hereafter called plaintiff, shipped 1,600 sheep from Texline, Tex., to Lamont, Okla. The shipment was delivered to the Ft. Worth & Denver City Railroad at Texline, was carried by it to Quanah, Tex., where it was delivered to the plaintiff in error, hereafter called defendant.
