This action was insti-tifted in the district court of Beckham county by the defendant in error, hereinafter referred to as plaintiff, against the plaintiff in error, hereinafter referred to as defendant, to recover upon a contract of fire insurance.'

The execution and delivery of the policy of insurance and the total destruction by fire of the property insured were admitted. The sufficiency of the petition to withstand a general demurrer and the breach by the pláintiff of certain provisions of the policy of insurance were relied upon by the defendant to defeat the action.
