This case raises the question of when this Court is bound by Supreme Court precedent. The majority holds that Purkett v. Elem, 514 U.S. 765, 115 S.Ct. 1769, 131 L.Ed.2d 834 (1995), does not apply in the military context when the prosecutor sets forth a race-neutral explanation for a peremptory strike against an African-American which is not objectively verifiable by the trial judge and is disputed by the parties.
