This suit is brought by the trustee named in a trust agreement of which the decedent George E. Emmons is the settlor, for a judgment approving its accounts, and for a determination as to the rights, shares and interests of the parties in the property comprising the trust fund. The original trust agreement was made June 20, 1927, and thereafter on April 21, 1937, it was amended and changed by the substitution of a new agreement. The appellant is Nathaniel D.
