—In a proceeding pursuant to CPLR article 78 to review a determination of the Superintendent of the Fishkill Correctional Facility penalizing the petitioner for a violation of the inmate behavior code, the appeal is from a judgment of the Supreme Court, Dutchess County, dated June 6, 1978, which (1) directed that the "disciplinary action taken by the Superintendent’s hearing * * * be expunged” and (2) restored petitioner’s good time.
