Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County), to review a determination of respondent Director of Special Housing Units which found petitioner guilty of violating certain prison disciplinary rules.
We agree with petitioner that he was not given the meaningful assistance required by 7 NYCRR 251-4.2. Petitioner, who was involved in a fight with another inmate while leaving the television room, asked his employee assistant to interview other inmates in the television room at the time of the fight.
