OPINION AND ORDER

GARCIA-GREGORY, District Judge.

Pending before the Court is Defendant Gilben Camacho Izquierdo’s (“Defendant”) Motion to Dismiss. (Docket Ño. 7). For the reasons set forth below, the Court DENIES Defendant’s Motion.

FACTUAL AND PROCEDURAL BACKGROUND
