This is an application for mandamus filed by relators, Thomas V. Ellzey and wife, Elvira Ellzey, against Honorable Jack Allen, District Judge of the 84th Judicial District of Texas, respondent, seeking to compel respondent to set aside an order of mistrial and render final judgment for relators in Cause No. 595 in the District Court of Ochiltree County in which Paul Ellzey, Carlos Ellzey, Dwight Ellzey, Callie Ellzey Smith, joined by her husband, A.
